Terms of Service for WA Scheduler

WA Scheduler is an independent app by Binary Script. It is not affiliated with, endorsed by, sponsored by or connected to WhatsApp LLC or Meta Platforms, Inc. WhatsApp is a trademark of WhatsApp LLC, used here only to describe what the app works with.

These Terms of Service ("Terms") are a legally binding agreement between you and BinaryScript Private Limited ("Binary Script," "we," "us," or "our") for your use of the WA Scheduler mobile application (the "App").

1. Agreement to Terms

By installing or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

2. The App

The App schedules messages and Status posts to go out on WhatsApp at a time you pick, even with the phone locked. Messages can go to one person, a group you are in, or a list of up to 10 people; Status posts can be photos or text cards. The App also offers repeats, birthday and occasion reminders, a library of captions and photos, and a history of sends.

The App connects to your WhatsApp as a linked device (like WhatsApp Web) using an unofficial client library. It does not use screen automation or an accessibility service.

3. No Affiliation and Account Risk

Please read this before you use the App.

WA Scheduler is not affiliated with, endorsed by or sponsored by WhatsApp or Meta.
The App uses an unofficial client. Using an unofficial client may go against WhatsApp's Terms of Service, and WhatsApp may temporarily or permanently limit or ban accounts that use one.
The App sends at a calm pace with a daily limit to lower this risk, but it cannot remove it. Use a number you can afford to risk.
We are not responsible for any restriction, suspension or ban that WhatsApp places on your account.

4. Eligibility

You must be at least 18 years old to use the App. You must have your own WhatsApp account and use it in line with WhatsApp's Terms of Service.

5. Your Responsibilities

Send messages only to people who expect them. Do not send spam, unsolicited bulk messages or messages the recipient has not agreed to receive.
Follow WhatsApp's Terms of Service and all laws that apply to you, including laws on marketing messages, privacy and consent.
You are solely responsible for the content of the messages and Status posts you schedule, and for the people you send them to.
Do not use the App to send content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, fraudulent or that infringes anyone's rights.
Do not try to copy, modify, reverse engineer or resell the App.

6. Plans and Billing

The App offers monthly and yearly subscriptions, each with a one-time free trial per user (3 days for monthly, 7 days for yearly), and a one-time lifetime purchase.
Outside India, purchases are made through Google Play and are governed by Google Play's terms.
In India, subscriptions are paid by UPI AutoPay through PhonePe, as an auto-renewing mandate, after you sign in with Google.
Subscriptions renew automatically until cancelled. If you do not cancel before a free trial ends, the subscription starts and you are charged.
Scheduled sends need an active subscription or the in-app demo. Without one, due messages stay pending until you subscribe.

7. Delivery

The App sends messages at the time you pick, but delivery depends on your phone, its battery and alarm settings, your internet connection, WhatsApp's service and your WhatsApp link staying active. We do not guarantee that every message will be sent or delivered at the exact time.

8. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the App will be uninterrupted, error-free or keep working with WhatsApp, which may change at any time.

9. Limitation of Liability

To the maximum extent permitted by law, BinaryScript Private Limited is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, business, messages or access to your WhatsApp account, arising from your use of the App.

10. Termination

You can stop using the App at any time by unlinking it and uninstalling it. We may suspend or end your access if you break these Terms.

11. Changes to These Terms

We may update these Terms. The "Last Updated" date above shows the latest version. Continued use of the App after a change means you accept the updated Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts in Raipur, Chhattisgarh, India.
