Agreement to Terms

These Terms of Service ("Terms") are a legally binding agreement between you ("User", "you", or "your") and Binaryscript Private Limited ("Company", "we", "us", or "our") concerning your access to and use of the Shadestack mobile game (the "App"), published under our Spames label.

1. Eligibility

1.1 Age

The App is made for adults and is not directed at children. You must be at least 13 years old, or the minimum age at which you may consent to the processing of your personal data where you live, to use it. If you are under 18, you may use the App only with the involvement of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for any purchases you make.

1.2 Legal Capacity

By using the App you represent that you have the legal capacity to enter into this agreement, or that a parent or guardian has done so for you.

1.3 Compliance

You agree to comply with all applicable local, national and international laws in your use of the App.

2. Licence to Use the App

2.1 Grant of Licence

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download, install and use the App on devices you own or control, for your personal, non-commercial entertainment.

2.2 Restrictions

You may not:

• Copy, modify, translate or create derivative works of the App, its levels, art or sounds
• Reverse engineer, decompile or disassemble the App, except where the law expressly permits it
• Rent, lease, sell, sublicense or distribute the App
• Remove or alter any copyright, trademark or other notice in the App

2.3 Ownership

The App is licensed, not sold. We and our licensors keep all rights, title and interest in it.

3. The Game

3.1 What the App Is

Shadestack is a single-player puzzle game: you sort coloured blocks between containers until each holds one colour in order from light to dark. It also offers a daily challenge, boosters, themes and settings for colour-blind players.

3.2 Levels

Levels are generated by our own tools and checked to be solvable without boosters. We may change the order, difficulty and content of levels at any time, including through settings downloaded while you play.

3.3 Changes to the App

We may add, change or remove features, levels, themes, items and prices at any time, and may stop offering the App. We will try to give notice of significant changes in the App or through its store listing.

3.4 No Warranty of Availability

We do not guarantee that the App will always be available, work on every device, or be free of errors. Some features, such as ads, rewards and settings downloaded from our service providers, need an internet connection.

4. Coins, Boosters and Other Virtual Items

• Virtual Items are stored on your device. If you uninstall the App, clear its data or change devices without a device backup, unspent coins and boosters can be lost. Purchases that you own permanently, such as remove-ads, can be restored as described in Section 5.4.
• We may change how Virtual Items are earned, priced or used, as part of balancing the game.
• We may remove Virtual Items obtained through errors, cheating or fraud.

5. Purchases

5.1 What You Can Buy

The App is free to download and to play. It offers optional in-app purchases of items with fixed contents, such as coin packs, boosters, bundles and the option to remove the ads shown between levels. Each item's contents and price are shown before you buy. There are no paid random rewards.

5.2 Billing

Purchases are made through Google Play or the Apple App Store and charged to your store account. Their terms apply to the payment. We never receive your card details or billing information.

5.3 Remove Ads

The remove-ads purchase turns off the full-screen ads shown between levels on the store account you bought it with. Rewarded ads, which you choose to watch for a reward, stay available as an option.

5.4 Restoring Purchases

You can restore permanent purchases, such as remove-ads, from the App's Settings, on a device signed in to the same Google Play or App Store account. Consumable items, such as coins and boosters, are used up when spent and cannot be restored.

5.5 Price Changes

Prices are set in the store and may change. A change does not affect purchases already made.

5.6 Refunds

Refunds are handled by Google Play or the App Store under their own policies. See our Refund Policy.

6. Ads

The App shows ads from third-party advertising partners: optional rewarded ads, and full-screen ads between levels, never during a level. We do not control the content of every ad, and an ad does not mean we endorse the advertiser. How ads use your data, and your choices about it, are described in the Privacy Policy.

7. Your Data

7.1 No Account

The App has no account and no sign-in. Your progress is tied to your device.

7.2 Data Loss

We do not keep a copy of your progress and cannot recover it if it is lost from your device.

7.3 Privacy

Our collection and use of information is described in the Privacy Policy, which forms part of these Terms.

8. Prohibited Uses

You agree not to:

• Cheat, or use bots, modified versions of the App or other tools to gain Virtual Items or rewards
• Tamper with purchases, receipts or ad rewards, or obtain items without paying for them
• Generate false ad views or clicks, or otherwise interfere with the App's advertising
• Interfere with or disrupt the App or the services it uses
• Use the App for any unlawful purpose

9. Intellectual Property Rights

9.1 Our Property

The App, including its levels, rules presentation, art, sounds, text and code, is owned by Binaryscript Private Limited or its licensors and is protected by copyright and other laws.

9.2 Trademarks

"Shadestack", "Spames", "BinaryScript" and related names and logos are our trademarks. You may not use them without our written permission.

9.3 Third-Party Components

The App includes third-party software under their own licences.

9.4 Feedback

If you send us ideas or suggestions, we may use them without any obligation to you.

10. Disclaimer of Warranties

11. Limitation of Liability

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms excludes liability that cannot lawfully be excluded, or limits your statutory rights as a consumer.

12. Indemnification

You agree to indemnify and hold harmless Binaryscript Private Limited and its directors, employees and agents from any claim, demand, loss, liability or expense (including reasonable legal fees) arising out of your use of the App, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

13.1 By You

You may stop using the App at any time by uninstalling it.

13.2 By Us

We may suspend or terminate your licence to use the App at any time, without notice, if you breach these Terms.

13.3 Effect

On termination, your licence and your licence to any Virtual Items end, and you must stop using and delete the App. Sections 4, 7, 9, 10, 11, 12 and 15 survive termination.

14. Third-Party Services and App Stores

14.1 Google Play

Your download and use of the App is also subject to the Google Play Terms of Service. Google is not a party to these Terms and has no obligation to provide support for the App.

14.2 Apple App Store

If you obtained the App from the Apple App Store: these Terms are between you and us only, not with Apple; Apple has no obligation to provide maintenance or support; in the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any), and Apple has no other warranty obligation; Apple is not responsible for addressing any claim by you or a third party relating to the App, including product liability, legal compliance and intellectual property claims; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14.3 Service Providers

The App uses analytics, crash reporting, remote settings and advertising services from third parties, as described in the Privacy Policy. Those services are governed by their own terms and privacy policies.

14.4 Store Purchases

Purchases are also subject to the Google Play Terms of Service or Apple's Media Services Terms and Conditions, as applicable.

15. Governing Law and Disputes

These Terms are governed by the laws of India, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the App is subject to the exclusive jurisdiction of the courts in Raipur, Chhattisgarh, India.

16. General

16.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App.

16.2 Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force.

16.3 No Waiver

Our failure to enforce any right or provision is not a waiver of it.

16.4 Assignment

You may not assign these Terms. We may assign them in connection with a merger, acquisition or sale of assets.

16.5 Changes to These Terms

We may update these Terms from time to time. Changes take effect when published, and the "Last Updated" date above will change. Your continued use of the App after an update constitutes acceptance.
