Terms of Service for SecretCall

1. Agreement to Terms
By downloading, installing, or using SecretCall (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you ("you," "your," or "User") and BinaryScript ("we," "us," "our," or "Company").
1.1 Changes to Terms
We reserve the right to modify these Terms at any time. Your continued use of the App after modifications constitutes acceptance of the updated Terms.
2. Eligibility
2.1 Age Requirement
You must be at least 13 years of age to use SecretCall. If you are under 18, you represent that you have obtained parental or guardian consent to use the App.
2.2 Account Requirements
To use SecretCall, you must:
- Have a valid phone number for verification
- Agree to these Terms and our Privacy Policy
- Provide accurate and complete information during registration
- Maintain the security and confidentiality of your account
3. Description of Service
3.1 Service Overview
SecretCall is a privacy-focused calling application that enables users to:
- Make anonymous calls with number masking
- Keep your real phone number hidden from call recipients
- Access contacts for easy dialing
- Track call history locally on your device
3.2 Service Availability
SecretCall is currently available in India. The service requires:
- An active internet connection
- A valid Indian phone number for registration
Important Notice
SecretCall is intended for legitimate privacy purposes such as:
- Responding to classified ads and online listings
- Business inquiries without sharing personal numbers
- Privacy-conscious communication
Misuse of anonymous calling for illegal or harmful purposes is strictly prohibited.
4. Subscription and Payment
4.1 Free Minutes
New users receive 2 free minutes upon sign-up to experience the service.
4.2 Subscription Plans
After using free minutes, you must subscribe to continue using SecretCall. Subscriptions include:
- Monthly minute quota
- Number masking on all calls
- Full call history access
- Priority support
4.3 Billing
- Subscriptions are processed through Google Play Store
- Subscriptions auto-renew unless cancelled
- Prices are subject to change with notice
- Unused minutes do not roll over to the next billing period
4.4 Cancellation
You may cancel your subscription at any time through Google Play Store settings. Upon cancellation:
- Your subscription remains active until the end of the current billing period
- Unused minutes will expire at the end of the billing period
- No refunds are provided for unused minutes
5. User Conduct and Responsibilities
5.1 Acceptable Use
You agree to use SecretCall in a lawful and responsible manner. You will:
- Comply with all applicable laws and regulations
- Respect the privacy and rights of others
- Use the App for its intended legitimate purposes
- Report any misuse or abuse to us
5.2 Prohibited Conduct
Strictly Prohibited Activities
You may NOT use SecretCall to:
- Make threatening, harassing, or abusive calls
- Engage in fraud, scams, or identity theft
- Violate any local, state, national, or international law
- Impersonate others or misrepresent your identity for harmful purposes
- Make prank calls to emergency services
- Conduct telemarketing or spam calls
- Stalk, harass, or intimidate any person
- Engage in any activity that could harm others
Violation of these prohibitions may result in immediate account termination and may be reported to law enforcement authorities.
6. Call Recording and Monitoring
SecretCall does NOT record your calls. However:
- We retain call metadata (duration, timestamp, destination number) for up to 90 days
- Call history is stored locally on your device
- We may cooperate with law enforcement when legally required
7. Intellectual Property
7.1 Our Content
All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, and software, are owned by BinaryScript and are protected by intellectual property laws.
7.2 Your License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
8. Disclaimers and Warranties
8.1 "AS IS" Service
SECRETCALL IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR RELIABILITY
- UNINTERRUPTED OR ERROR-FREE OPERATION
8.2 Service Limitations
We do not guarantee:
- 100% anonymity in all circumstances
- Call quality or connection reliability
- Availability of service in all locations
- Compatibility with all devices or carriers
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BINARYSCRIPT SHALL NOT BE LIABLE FOR:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
- DAMAGES RESULTING FROM MISUSE OF THE SERVICE
- DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT
- ANY ACTIONS TAKEN BY THIRD PARTIES BASED ON CALLS MADE THROUGH OUR SERVICE
10. Indemnification
You agree to indemnify, defend, and hold harmless BinaryScript from any claims, liabilities, damages, losses, costs, or expenses arising from:
- Your use or misuse of SecretCall
- Your violation of these Terms
- Your violation of any law or third-party rights
- Any calls you make using the service
- Any harm caused to others through your use of the service
11. Termination
11.1 Termination by You
You may terminate your account at any time by:
- Deleting your account through the App settings
- Emailing support@binaryscript.in with a termination request
- Uninstalling the App (note: this does not delete your account data)
11.2 Termination by Us
We may suspend or terminate your account immediately, without notice, if:
- You violate these Terms or our policies
- You engage in illegal or harmful conduct
- We are required to do so by law
- We suspect fraudulent or abusive activity
- We decide to discontinue the service
11.3 Effect of Termination
Upon termination:
- Your right to use the App immediately ceases
- Unused subscription minutes are forfeited
- We will delete your account data within 30 days
- Local data on your device remains until you clear it
12. General Provisions
12.1 Entire Agreement
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and BinaryScript regarding SecretCall.
12.2 Governing Law
These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in India.
12.3 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
