Terms of Service for LaborBook

These Terms of Service ("Terms") govern your access to and use of the LaborBook mobile application ("App"). Please read these Terms carefully, and contact us if you have any questions. By using LaborBook, you agree to be bound by these Terms.

1. App Description

LaborBook is a comprehensive labor and attendance management mobile application designed for businesses, contractors, and organizations to manage their workforce efficiently. The app enables you to:

• Track employee attendance with check-in/check-out features
• Manage employee records and workforce information
• Record and monitor work hours and overtime
• Generate attendance reports and analytics
• Calculate wages and manage payroll data
• Track leave and absence records
• Monitor site-wise or project-wise labor deployment
• Store and manage employee documents

2. Your Use of LaborBook

To use LaborBook, you must:

• Create an account with accurate and complete information
• Provide truthful employee information for those you manage through the app
• Comply with these Terms and all applicable laws and regulations
• Be at least 18 years of age or have parental/guardian consent
• Use the app for lawful business and employment purposes only
• Have the legal authority to manage the employee data you input into the app

3. User Responsibilities and Compliance

When using LaborBook, you are responsible for:

Data Accuracy and Legal Compliance

• Ensuring the accuracy of all employee information and attendance records
• Complying with applicable labor laws, employment regulations, and minimum wage requirements
• Maintaining proper employment contracts and documentation
• Obtaining necessary consent from employees for data collection and processing
• Complying with data protection and privacy laws in your jurisdiction

Account Security

• Protecting your account credentials and maintaining account security
• Not sharing your account access with unauthorized persons
• Immediately notifying us of any unauthorized access or security breaches
• Taking responsibility for all activities under your account

Prohibited Uses

You may not use LaborBook to:

• Violate any labor laws, employment regulations, or workers' rights
• Store or process data of individuals without their knowledge or consent
• Engage in any fraudulent, illegal, or harmful activities
• Manipulate attendance records or payroll data for illegal purposes
• Circumvent any limitations or restrictions of the app
• Reverse engineer, decompile, or attempt to extract the source code

4. Service Limitations

Please be aware of the following limitations:

• LaborBook is a tool for workforce management and does not replace legal employment documentation
• Attendance tracking accuracy depends on proper usage and employee cooperation
• GPS-based features require device permissions and may be affected by signal availability
• Report generation and data accuracy depend on the quality of input data
• The app requires an internet connection for cloud sync and certain features
• Free version features may be limited; certain advanced features require a premium subscription

5. Subscription Terms

LaborBook offers premium features through subscription plans:

• Free Plan: Basic attendance tracking with limited employees and features
• Premium Plans: Unlimited employees, advanced reports, payroll management, document storage, and priority support

Subscription Details

• Subscriptions are processed through Google Play Store
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Subscription management and cancellation are handled through your Google Play account settings
• Pricing, features, and plan availability may change with notice to active subscribers
• No refunds are provided for unused portions of subscription periods, except as required by law
• Downgrading from premium to free may result in loss of data exceeding free plan limits

6. Employee Data and Privacy

You acknowledge and agree that:

• You are responsible for obtaining proper consent from employees for data collection
• You must inform employees about what data is collected and how it's used
• You must comply with applicable data protection and privacy laws
• BinaryScript Private Limited acts as a data processor; you are the data controller
• You are responsible for ensuring employee rights are protected
• Employee data must be used only for legitimate business and employment purposes

7. Ownership and Intellectual Property

The App, including all content, features, and functionality, is owned by BinaryScript Private Limited and is protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or attempt to extract the source code
• Remove any copyright, trademark, or other proprietary notices
• Transfer, sublicense, or assign your rights to use the App
• Use the App to create competing products or services
• Distribute or resell the App or any of its features

8. User Content and Data Ownership

The employee records, attendance data, and other information you create using LaborBook are considered your content. You retain all rights to this content. However, you grant us a limited license to:

• Store your data on our servers for the purpose of providing cloud sync features
• Process your data to provide app features, reports, and analytics
• Backup your data to prevent data loss
• Use anonymous, aggregated data to improve our services and develop new features

You can export and delete your content at any time through the app settings or by deleting your account.

9. Data Security and Backups

We take data security seriously:

• Your data is encrypted in transit and at rest
• We implement industry-standard security measures
• We perform regular security audits and updates
• We recommend that you maintain your own backups of critical data

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that:

• The App will meet your specific business requirements
• The App will be uninterrupted, timely, secure, or error-free
• Attendance records or reports will be 100% accurate
• The App will comply with all labor laws in your jurisdiction (you are responsible for ensuring compliance)
• Data loss will never occur (we recommend maintaining backups)
• The App will be compatible with all devices or operating system versions

11. Limitation of Liability

IN NO EVENT SHALL BINARYSCRIPT PRIVATE LIMITED BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

• Loss of business data, employee records, or attendance information
• Financial losses due to payroll errors, incorrect calculations, or data inaccuracies
• Labor disputes or legal issues arising from use of the App
• Penalties or fines from regulatory authorities due to non-compliance with labor laws
• Loss of business opportunities or damage to business reputation
• Any damages arising from reliance on reports or data generated by the App

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR SUBSCRIPTIONS IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold BinaryScript Private Limited harmless from any claims, damages, liabilities, costs, or expenses (including attorney's fees) arising from:

• Your use of the App or data stored in the App
• Violation of these Terms or applicable laws
• Violation of employee rights or labor laws
• Infringement of any third-party rights
• Disputes with employees regarding attendance records or payroll
• Any data breaches resulting from your failure to secure your account

13. Labor Law Compliance

You acknowledge that:

• LaborBook is a tool and does not provide legal advice
• You are solely responsible for compliance with all applicable labor laws, minimum wage requirements, overtime regulations, and employment standards
• You must maintain proper employment records as required by law
• You must ensure fair treatment of employees and compliance with workers' rights
• BinaryScript Private Limited is not responsible for your compliance with labor laws

14. Modifications to the App and Terms

We reserve the right to modify the App or these Terms at any time:

• We may add, modify, or remove features from the App
• We may suspend or discontinue the App or specific features
• Terms modifications will be effective upon posting with a new "Last Updated" date
• We will provide notice of material changes through the App or via email
• Your continued use of the App after changes constitutes acceptance of updated Terms

15. Termination

We may terminate or suspend your access to the App without prior notice for violations of these Terms or for any other reason at our discretion. You may also terminate your account at any time through the app settings. Upon termination:

• Your right to use the App will cease immediately
• Your subscription will be canceled (refunds subject to our Refund Policy)
• You should export your data before termination
• We may delete your account data after 30 days, as described in our Privacy Policy
• Provisions that should survive termination will remain in effect

16. Data Export and Portability

You have the right to:

• Export your data at any time in standard formats (CSV, Excel, PDF)
• Request a copy of all your data
• Transfer your data to another service

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in India.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

19. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and BinaryScript Private Limited regarding the use of the App.
