Terms of Service for Restaurant POS

These Terms of Service ("Terms") govern your access to and use of the Restaurant POS mobile application ("App") operated by Binaryscript Private Limited ("Company," "we," "our," or "us").

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE APP.

By downloading, installing, or using Restaurant POS, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

1.1 By using Restaurant POS, you agree to:

• All applicable laws and regulations

1.2 You must be at least 13 years of age to use this App. By using the App, you represent that you meet this requirement.

1.3 If you are using the App on behalf of a business, you represent that you have authority to bind that business to these Terms.

Restaurant POS is an offline-first point-of-sale and restaurant management application that provides:

• All data is stored locally on your device
• The App functions without internet connectivity
• Internet is only required for cloud backup and analytics

3. License Grant

3.1 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Use the App for your personal or business restaurant management needs

4. Subscription Plans and Pricing

Restaurant POS offers a freemium model with the following plans:

• Price changes do NOT affect existing subscriptions

• Prices may not include applicable taxes (GST, VAT, etc.)
• You are responsible for all taxes associated with your purchase

5. Payment and Billing

5.1 Payment Methods

Payments are processed through:

• Google Play Store (Android)
• Apple App Store (iOS)

You agree to provide accurate and complete payment information.

• You can cancel subscriptions at any time through:

• Cancellation takes effect at the end of the current billing period
• You retain access until the end of the paid period

All purchases are final and non-refundable, including:

• Monthly subscriptions

• Lifetime purchases

Refunds may be granted at our sole discretion in cases of:

• Technical issues preventing App functionality

Your use of the App is also governed by our Privacy Policy, available at www.binaryscript.com/privacy or within the App.

13.2 Local Data Storage

• All your business data is stored locally on your device
• We do NOT access, collect, or store your business data
• You are solely responsible for data security and backups

13.3 Analytics

• We use Firebase Analytics and Crashlytics for app improvement
• This data is anonymous and cannot identify you

14. Updates and Modifications

14.1 App Updates

• We may release updates, upgrades, or new versions
• Updates may include new features, bug fixes, or security patches
• Some updates may be automatic; others may require manual installation
• We are not obligated to provide updates

14.2 Changes to Features

We reserve the right to:

• Modify or discontinue features
• Change functionality or user interface
• Add or remove capabilities

We will provide reasonable notice for significant changes.

• We may update these Terms at any time
• Changes will be posted with a new "Last Updated" date

15. Termination

Upon termination:

• Your license to use the App ends immediately
• You must delete the App from all devices
• Paid subscriptions are non-refundable (unless required by law)
• Your local data remains on your device until you delete it

16. Governing Law and Jurisdiction

These Terms are governed by the laws of India, without regard to conflict of law principles.

16.2 Jurisdiction

Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts in Chattisgarh, India.

Before filing any legal action, you agree to attempt to resolve disputes through:

• Firebase Crashlytics (Google)
• Google Drive (optional backup)
• iCloud (optional backup, iOS only)

These services have their own terms and privacy policies. We are not responsible for third-party services.

18.2 Third-Party Links

The App may contain links to third-party websites or services. We are not responsible for their content, terms, or practices.

19. Additional Provisions

19.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

19.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Binaryscript Private Limited regarding the App, superseding any prior agreements.

19.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

19.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

19.5 Force Majeure

We are not liable for any failure or delay due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, government actions, or internet failures.

Provisions that by their nature should survive termination shall survive, including: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law.
