Terms of Service for MY QR

These Terms of Service ("Terms") govern your access to and use of the MY QR mobile application ("App"). Please read these Terms carefully, and contact us if you have any questions. By using MY QR, you agree to be bound by these Terms.

1. App Description

MY QR is a mobile application that enables users to generate, customize, and share QR codes for various purposes, with a primary focus on UPI payment QR codes. The app allows you to create professional QR codes for receiving payments, sharing contact information, URLs, and other data types. MY QR also provides features for managing multiple QR codes, tracking scan analytics, and customizing QR code designs.

2. Your Use of MY QR

To use MY QR, you must:

  • Create an account using your email address or Google account
  • Provide accurate and complete information, including a valid UPI ID for payment QR codes
  • Comply with these Terms and applicable laws and regulations
  • Be at least 13 years of age (or the applicable age of digital consent in your jurisdiction)
  • Use the app for lawful purposes only
3. User Responsibilities

When using MY QR, you are responsible for:

  • Ensuring the accuracy of information included in your QR codes, particularly UPI IDs
  • Verifying that QR codes function correctly before sharing with customers or contacts
  • Protecting your account credentials and maintaining account security
  • Not using the app to create QR codes for illegal, fraudulent, or harmful purposes
  • Not attempting to circumvent any limitations or restrictions of the app
4. Service Limitations

Please be aware of the following limitations:

  • QR code generation depends on the accuracy of the information you provide
  • Payment QR codes require valid UPI IDs to function properly
  • QR code scanning success depends on factors including:
    • Display quality and screen brightness
    • Scanner app compatibility
    • Network connectivity for dynamic QR codes
    • Physical print quality for printed QR codes
  • The app requires an internet connection for account management and cloud features
  • Certain advanced features are only available to premium subscribers
5. Subscription Terms

MY QR offers premium features through subscription plans:

  • Free Plan: Basic QR code generation with limited features and advertisements
  • Premium Plans: Remove ads, unlock advanced customization, unlimited QR codes, analytics, and premium templates

Subscription terms:

  • Subscriptions are processed through Google Play Store
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • Subscription management and cancellation are handled through your Google Play account settings
  • Pricing, features, and plan availability may change, but you will be notified before any changes affect your active subscription
  • No refunds are provided for unused portions of subscription periods, except as required by law
6. QR Code Usage and Payments

For payment QR codes specifically:

  • You are responsible for ensuring your UPI ID is correct and active
  • BinaryScript Private Limited is not a payment processor and does not handle any financial transactions
  • All payments made through UPI QR codes are processed by your bank and UPI service provider
  • We are not responsible for failed transactions, incorrect payments, or disputes arising from QR code usage
  • You must comply with all applicable payment regulations and tax requirements in your jurisdiction
7. Ownership and Intellectual Property

The App, including all content, features, and functionality, is owned by BinaryScript Private Limited and is protected by copyright, trademark, and other intellectual property laws. You may not:

  • Copy, modify, or create derivative works of the App
  • Reverse engineer, decompile, or attempt to extract the source code
  • Remove any copyright, trademark, or other proprietary notices
  • Transfer, sublicense, or assign your rights to use the App
  • Use the App to create competing products or services
8. User Content and Data

The QR codes and associated data you create using MY QR are considered your content. You retain all rights to this content. However, you grant us a limited license to:

  • Store your QR code data on our servers for the purpose of providing cloud sync features
  • Process your data to provide app features and analytics
  • Use anonymous, aggregated data to improve our services

You can delete your content at any time through the app settings or by deleting your account.

9. Privacy and Security

MY QR processes personal information including your name, email address, and UPI ID. We take security seriously:

  • Your data is encrypted in transit and at rest
  • We use Firebase Authentication for secure account management
  • UPI IDs are stored securely in our database and used only for QR code generation
  • We implement industry-standard security measures to protect your information

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that:

  • The App will meet your specific requirements or business needs
  • The App will be uninterrupted, timely, secure, or error-free
  • QR codes generated will be scannable in all circumstances or with all scanner apps
  • Payment QR codes will result in successful transactions
  • The App will be compatible with all devices or operating system versions
11. Limitation of Liability

IN NO EVENT SHALL BINARYSCRIPT PRIVATE LIMITED BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, or business opportunities
  • Financial losses due to incorrect QR codes, failed payments, or technical issues
  • Loss of customers or damage to business reputation
  • Any damages arising from reliance on QR codes generated by the App
  • Unauthorized access to your account or data

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR SUBSCRIPTIONS IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold BinaryScript Private Limited harmless from any claims, damages, liabilities, costs, or expenses (including attorney's fees) arising from:

  • Your use of the App or QR codes generated through the App
  • Violation of these Terms or applicable laws
  • Infringement of any third-party rights
  • Any disputes related to payments received through your QR codes
13. Modifications to the App and Terms

We reserve the right to modify the App or these Terms at any time:

  • We may add, modify, or remove features from the App
  • We may suspend or discontinue the App or specific features
  • Terms modifications will be effective upon posting the updated Terms with a new "Last Updated" date
  • We will provide notice of material changes through the App or via email
  • Your continued use of the App after changes constitutes acceptance of the updated Terms
14. Termination

We may terminate or suspend your access to the App without prior notice for violations of these Terms or for any other reason at our discretion. You may also terminate your account at any time through the app settings. Upon termination:

  • Your right to use the App will cease immediately
  • Your subscription will be canceled (refunds subject to our Refund Policy)
  • We may delete your account data after 30 days, as described in our Privacy Policy
  • Provisions of these Terms that by their nature should survive termination will remain in effect
15. Compliance with Laws

You agree to comply with all applicable laws and regulations when using MY QR, including:

  • Payment regulations and UPI guidelines
  • Tax requirements for business transactions
  • Data protection and privacy laws
  • Anti-fraud and anti-money laundering regulations
16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in India.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

18. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and BinaryScript Private Limited regarding the use of the App.
